Nissan Lemon Law: Warranty, Dispute Program & Your Rights

The short answer

Your state’s lemon law covers a new Nissan like any other vehicle. Nissan’s 3-year / 36,000-mile basic warranty outlasts most state windows, and Nissan and Infiniti are national participants in BBB AUTO LINE.

Whether it is a Rogue, an Altima or a Frontier, a Nissan that keeps going back for the same problem may qualify under your state’s lemon law. The law decides when Nissan has to buy it back or replace it; Nissan’s warranty and dispute program decide how the process runs.

This guide covers Nissan’s published warranty, its BBB AUTO LINE participation and the windows in each state.

How long state lemon laws protect a Nissan

With 3 years / 36,000 miles of basic coverage, your Nissan’s warranty usually outlasts its lemon law window. A two-year state closes the window with 1 year of warranty to go; a one-year state, with 2 years. Repairs in that gap are free, but they rarely count toward a buyback.

When the lemon law window closes for a new Nissan
State windowJurisdictionsNissan basic warranty at that point
The warranty termNew Hampshire, VermontWindow lasts the full 3 years / 36,000 miles
Three years1about the same time the basic warranty ends
Two years211 year of basic coverage still left
18 months318 months of basic coverage still left
One year232 years of basic coverage still left

Many windows also stop at 12,000 to 24,000 miles, long before the 36,000-mile limit on a Nissan warranty. Find your state’s exact rule in our state guides, or check your Nissan repair history against your state’s window.

Nissan’s dispute program

BBB National Programs lists Nissan as a national participant in BBB AUTO LINE, so certain warranty and lemon law disputes are accepted from all states. Infiniti and Nissan’s light commercial vehicles have their own BBB participant pages.

BBB AUTO LINE is free and does not need a lawyer. Call 1-800-955-5100.

Electric Nissans and the lemon law

Nissan’s EVs, such as the LEAF, get the same 3-year / 36,000-mile basic and 5-year / 60,000-mile powertrain coverage, plus Nissan’s EV limited warranty: an 8-year / 100,000-mile battery warranty and coverage for the EV system and lithium-ion battery capacity.

That battery coverage does not stretch the lemon law window. If a charging fault or sudden range loss shows up in the first year or two, report it right away and make sure the repair order describes it in detail, with the charge level and range you saw. If it shows up later, the battery warranty still pays for repairs, but a buyback claim is much harder.

Things Nissan owners should know

  • Transmission complaints often get “no problem found” on the first visit. Ask the dealer to write your exact complaint on the repair order even when they cannot reproduce it.
  • Your warranty guide may say whether Nissan expects you to try BBB AUTO LINE before a state program. Read that page, and check your state’s guide.
  • Keep rental receipts. Several states let you recover incidental costs along with a refund.

What to do if your Nissan is a lemon

  1. Insist that each repair order records your exact complaint, especially when the dealer cannot reproduce it.
  2. Call Nissan customer service to open a case, and write the case number in your notes.
  3. Mail written notice to Nissan North America at the address in your warranty guide or required by your state; our letter generator handles the wording.
  4. Check whether your warranty guide or state requires BBB AUTO LINE first, and file at 1-800-955-5100.
  5. Move to your state’s program or court before the deadline if the result is not acceptable.

Frequently asked questions

Is there a Nissan lemon law?

No separate one. Your state’s lemon law covers a new Nissan; Nissan’s warranty and BBB AUTO LINE shape the process.

Does Nissan use BBB AUTO LINE?

Yes. BBB National Programs lists Nissan as a national participant, and Infiniti as a participant too.

How long is the Nissan warranty?

Nissan lists 3 years / 36,000 miles basic and 5 years / 60,000 miles powertrain.

Does a “no problem found” visit count?

It can still matter. Make sure your complaint is written on the order; whether the visit counts as a repair attempt depends on your state’s law.

Can I get my money back for a Nissan with a bad transmission?

If the defect substantially impairs the vehicle and meets your state’s test, yes: a refund or a replacement, usually less a use allowance.
