Kia Lemon Law: Warranty, Dispute Program & Your Rights

The short answer

Your state’s lemon law covers a new Kia. Kia’s 5-year / 60,000-mile basic warranty outlasts every fixed state window, and Kia takes part in BBB AUTO LINE on a state-by-state basis, so check your state’s Kia program summary.

Kia’s long warranty is a selling point, and it means repairs are paid for. But if the same defect keeps coming back, what you probably want is a refund or a new car, and that comes from your state’s lemon law, not the warranty.

Here is what Kia publishes about its coverage and dispute program, and how they fit your state’s window.

How long state lemon laws protect a Kia

With 5 years / 60,000 miles of basic coverage, your Kia’s warranty usually outlasts its lemon law window. A two-year state closes the window with 3 years of warranty to go; a one-year state, with 4 years. Repairs in that gap are free, but they rarely count toward a buyback.

Three years12 years of basic coverage still left
Two years213 years of basic coverage still left
18 months342 months of basic coverage still left
One year234 years of basic coverage still left

Many windows also stop at 12,000 to 24,000 miles, long before the 60,000-mile limit on a Kia warranty. Find your state’s exact rule in our state guides, or check your Kia repair history against your state’s window.

Kia’s dispute program

BBB National Programs says Kia participates in BBB AUTO LINE state by state: certain disputes are only eligible in certain states. BBB publishes a Kia program summary for each state, describing the claims Kia has agreed to arbitrate. Look up yours before you file.

BBB also runs arbitration for some Kia class action settlements (the Theta engine, E2 and HECU settlements). Those are separate from lemon law claims and follow each settlement’s terms. For BBB AUTO LINE, call 1-800-955-5100.

Towing, rentals and trip costs on a Kia

A lemon rarely fails at a convenient time. Kia’s roadside plan, for 5 years or 60,000 miles, covers towing to the nearest Kia dealer after a warranty-related breakdown, plus out-of-gas, flat-tire, jump-start and lock-out help.

If a warranty breakdown happens more than 150 miles from home and the repair takes more than 24 hours, Kia’s Trip Interruption Policy reimburses reasonable meals, lodging or rental car costs, up to $100 a day for three days per incident.

Keep every one of those receipts and the tow record. They show how often the defect stranded you, and several state lemon laws let you claim reasonable incidental costs on top of a refund. Your state’s page lists what it allows.

Things Kia owners should know

  • Read your state’s Kia program summary on the BBB site before you file; eligibility differs by state.
  • Kia offers trip-interruption reimbursement when a warranty breakdown happens more than 150 miles from home. Keep those receipts, too.
  • If your problem falls under an engine settlement, compare that route with a lemon law claim before you commit.

What to do if your Kia is a lemon

  1. Keep every Kia repair order, plus trip-interruption receipts if a breakdown happened far from home.
  2. Check recalls on your VIN, and whether a Kia settlement program covers your problem.
  3. Send written notice to Kia America, using the address in your manual or the one your state requires; our letter generator drafts it.
  4. Open BBB’s Kia program summary for your state to see if your claim is eligible, then call 1-800-955-5100.
  5. If it is not eligible or not resolved, file in your state’s program or court in time.

Frequently asked questions

Is there a Kia lemon law?

Does Kia use BBB AUTO LINE?

Yes, state by state. BBB publishes a Kia program summary for each state describing which disputes are eligible.

How long is Kia’s warranty?

Kia lists 5 years / 60,000 miles basic and 10 years / 100,000 miles powertrain.
